Title VI of the Civil Rights Act Complaint Process

Title VI - Statement of Non-discrimination

Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color or national origin in programs & activities receiving federal financial assistance (42 U.S.C. Section 200d). The Rockland Dept. of Public Transportation is committed to practicing non-discrimination. If you believe you have been subjected to discrimination, you may file a complaint with the Title VI Coordinator.

Title VI Complaint Process

Any person who believes he/she has been discriminated against on the basis of race, color, or national origin by the Rockland County Department of Public Transportation may file a Title VI complaint by completing and submitting the Department's Title VI Complaint Form to the address indicated on the form. Complaints must be filed no more than 180 days from the date(s) of the alleged incident.

Once the complaint form is received by the Rockland County Department of Public Transportation, it will be reviewed to determine whether the complaint constitutes a Title VI complaint and/or whether there is sufficient information for an investigation. The complainant will receive an acknowledgement letter informing him/her whether the complaint is covered under Title VI and/or if more information is needed for a Title VI investigation to take place. In the event more information is needed, the Department will contact the complainant, and the complainant shall be given a reasonable amount of time to provide the requested information. If the information is not received, the Department may administratively close the case. A case can be administratively closed if a complainant fails to cooperate with the investigation or indicates he/she no longer wishes to pursue his/her case.

Proceso de Queja Título VI

Una vez que el formulario de queja es recibido por el Departamento de Transportación Pública del Condado de Rockland, será revisado para determinar si la denuncia constituye una queja del Título VI y/o si hay información suficiente para una investigación. En el caso de que se necesite más información, el Departamento se pondrá en contacto con el denunciante y el denunciante dispondrá de un plazo razonable de tiempo para falicitar la información solicitada. Si la información no es recibida, el Departamento podrá cerrar administrativamente el caso. Un caso puede ser administrativamente cerrado si el denunciante no coopera con la investigación o indica que él/ella ya no desea continuar con su caso.

Title II of the Americans with Disabilities Act Complaint Process

Title II - Statement of Non-discrimination

Title II of the Americans with Disabilities Act of 1990 (ADA) protects qualified individuals with a disability from discrimination on the basis of that disability in the services, programs, or activities of the Rockland County Department of Public Transportation. This notice is posted to inform the public of the provisions of Title II of the ADA and the requirements of the federal ADA regulations.

Title II Complaint Process

The Rockland County Department of Public Transportation is committed to providing non-discriminatory service to ensure that no person is excluded from participation in, or denied the benefits of, or subjected to discrimination in the receipt of its services on the basis of disability as protected by the Americans with Disabilities Act of 1990 (ADA). If you have a complaint about the accessibility of our transit system or believe you have been discriminated against because of your disability, you are encouraged to file a complaint to our ADA Complaint Officer. Complaints can be filed through use of our ADA Discrimination Complaint Form.

If you need assistance in filing or writing your complaint, the ADA Complaint Officer or designee will, at your request, help locate an impartial advocate or representative not associated with the Rockland County Department of Public Transportation. You must also specify any other reasonable accommodation or alternate format you may require to effectively communicate your complaint. The ADA Discrimination Complaint Form must be filled out completely and filed with the Rockland County Department of Public Transportation within ninety (90) calendar days following the date of the alleged discrimination.

Once the completed ADA Discrimination Complaint Form is received by the Rockland County Department of Public Transportation it will be reviewed to determine whether the complaint constitutes a Title II complaint and/or whether there is sufficient information for an investigation. The complainant will receive an acknowledgement letter, within ten (10) business days, informing him/her whether the complaint is covered under Title II and/or if more information is needed for an ADA investigation to take place. Once all information is provided, an investigation of the complaint will be conducted.

Within twenty (20) business days of having received the complete complaint, including any additional information requested, the ADA Complaint Officer, or designee, will respond in writing with a process for resolution of the complaint that includes the following:

1. A description of the complaint;
2. A finding of facts;
3. A description of how the complaint will be resolved; and
4. When the complaint will be resolved.

If the Rockland County Department of Public Transportation is unable to resolve this complaint, the complainant will be notified in writing of this non-resolution by the ADA Complaint Officer, or designee, within twenty (20) business days of having received the complete complaint. This written notification will include:

1. A description of the complaint;
2. A finding of facts, if any; and
3. A summary of any resolution(s) proposed;

The complainant can appeal the decision in instances where he or she is dissatisfied with the resolution. This appeal should be made in writing within ten (10) business days after receipt of the response to the complaint and should include a copy of the resolution/ non-resolution correspondence and a detailed statement of the reason(s) for your request for appeal of the decision. The request for an appeal of the decision may be made in writing and directed to:

Este aviso se publica para informar al público sobre las disposiciones del Título II de la ADA y los requisitos de las regulaciones federales ADA.

Proceso de Queja Título II

El Departamento de Transportación Pública del Condado de Rockland se compromete a brindar un servicio no discriminatorio para garantizar que ninguna persona quede excluida de la participación, negada los beneficios o sujeta a discriminación en la recepción de sus servicios por motivos de discapacidad, según lo protegido por la Ley de Estadounidenses con Discapacidades de 1990 (ADA). Si necesita ayuda para presentar o redactar su queja, el Oficial de Quejas ADA o la persona designada, a pedido suyo, lo ayudarán a ubicar a un defensor o representante imparcial que no esté asociado con el Departamento de Transportación Pública del Condado de Rockland.
