New State Law Regarding Credit Card Surcharges In Effect

Effective February 11 Merchants Must Disclose Credit Card Surcharges  

New City, NY, - In honor of National Consumer Protection Week, County Executive Ed Day and Consumer Protection Director Kimberly Von Ronn encourage residents to be aware of a new law aimed at increasing the transparency of credit card transactions. 

Effective February 11, 2024, New York State passed a law mandating merchants statewide to clearly disclose credit card surcharges to consumers. The law limits credit card surcharges to the amount charged to the business by the credit card company and requires businesses to post before checkout the total price of an item or service inclusive of the credit card surcharge or a two-tiered pricing option, which requires the credit card price to be posted alongside the cash price. Sellers that violate the provision are liable for a civil penalty.
